JCAR 21-72 (MOAHR No. 2021-060 ST) Department of State, Bureau of Elections – Disqualification from Ballot Based Upon Contents of Affidavit of Identity. These rules were resubmitted to JCAR on March 9, 2022, after previously being withdrawn with permission on March 4, 2022. The last day for JCAR consideration is 6 session days from resubmission.

JCAR 21-73 (MOAHR No. 2021-061 ST) Department of State, Bureau of Elections – Signature Matching for Absent Voter Ballot Applications and Absent Voter Ballot Envelopes. These rules were resubmitted to JCAR on March 9, 2022, after previously being withdrawn with permission on March 4, 2022. The last day for JCAR consideration is 6 session days from resubmission.

JCAR 21-74 (MOAHR No. 2021-062 ST) Department of State, Bureau of Elections – Online Absent Voter Ballot Application. These rules were submitted to JCAR on March 4, 2022. The last day for JCAR consideration is 15 session days from submission.

JCAR 22-12 (MOAHR No. 2021-082 LE) Department of Labor and Economic Opportunity, Michigan Strategic Fund, State Historic Preservation Office – Historic Preservation Certification. These rules were submitted to JCAR on February 3, 2022. The last day for JCAR consideration is 15 session days from submission.

JCAR 22-14 (MOAHR No. 2021-053 LR) Department of Licensing and Regulatory Affairs, Director's Office, Social Work – General Rules. These rules were submitted to JCAR on February 17, 2022. The last day for JCAR consideration is 15 session days from submission.

JCAR 22-16 (MOAHR No. 2021-024 EQ) Department of Environment, Great Lakes, and Energy, Air Quality Division – Air Pollution Control. These rules were submitted to JCAR on March 8, 2022. The last day for JCAR consideration is 15 session days from submission.

How to Determine the Number of Session Days Left for JCAR Review of Rules**

Under MCL 24.245a, the Joint Committee on Administrative Rules generally has 15 session days to act on a set of rules submitted to the committee. To determine when that time will expire for a set of rules that you are interested in, do the following:

1. Determine the date the rules were submitted to JCAR.

2. Determine how many session days there have been since then. A session day is defined in MCL 24.245a(13) as a day in which both houses of the legislature convene and record a quorum. You can determine this yourself by checking the journals here: http://www.legislature.mi.gov/(S(ytvtdvrcvcc43eqxgk1prllj))/mileg.aspx?page=Journals (You may have to go to the bottom of the page and look at the appropriate journals from each house for the applicable time period.)

If 15 session days have passed and JCAR has not taken up the rules, the rules are probably no longer before JCAR, and have been or will soon be submitted to the Secretary of State and take effect.

Please note that under MCL 24.245a(12), a rule pending before the committee at the final adjournment of a regular session held in an even-numbered year must be withdrawn and resubmitted to the committee during the next session, at which point a new and untolled 15-session-day period begins.
