TEACHERS' TENURE ACT DEFINITION OF CERTIFICATED
Filed with the secretary of state on
These
rules become effective immediately upon after filing with the
secretary of state unless adopted under section 33, 44, or 45a(6)(9)
of the administrative procedures act of 1969, 1969 PA 306, MCL 24.233, 24.244,
and 24.245a. Rules adopted under these sections become effective 7 days after
filing with the secretary of state.

conferred on the superintendent of public instruction by section 2 of article
I of 1937 (Ex. Sess.) PA 4, MCL 38.72, section 15 of 1964 PA 287,
MCL 388.1015 and Executive Reorganization Order Nos. 1996-6 and No.
1996-7, MCL 388.993 and MCL 388.994)
R 390.661 of the Michigan Administrative Code is amended, as follows:
R 390.661 Certification of teachers Definition of
“certificated” under teachers' tenure act.
Rule 1. (1) For the purposes of teacher tenure under the
provisions of serving the probationary period under article II of
1937 (Ex. Sess.) PA 4, MCL 38.81 to 38.84, "certificated" means
1 or more of the following: as it refers to teachers, shall include any
teacher who holds
(a) Holding a Michigan teaching certificate, as that
term is defined by in R 390.1101, which that is
valid for the position to which he or she the teacher is assigned.
(b), or any teacher employed Being
employed in a school guidance counselor position and holding any
a Michigan teaching certificate,
as that term is defined in R 390.1101, with a school guidance counselor
endorsement.
(c), or any Being a teacher of students
with speech and language impairment who provides speech and language services
and who holds any a Michigan teaching certificate, as that
term is defined in R 390.1101, with an endorsement in speech and language
impairment, but shall not include nondegreed persons who hold special
certificates as teachers or teacher
aides in training in experimental programs.
(2) For the purposes of continuing tenure under article
III of 1937 (Ex. Sess.) PA 4, MCL 38.91 to 38.9238.93, "certificated"
means holding shall include any teacher who holds a Michigan
teaching certificate, as that term
is defined by in R 390.1101, but shall not include
nondegreed persons who hold special certificates as teachers or teacher aides
in training in experimental programs.
